Fighting Permanent Injunctions in Domestic Violence Cases


If you have been accused of physical violence or sexual assault in a domestic relationship, you will almost certainly face both criminal and civil charges. The civil charges first take the form of a temporary injunction prohibiting you from contacting the alleged victim. The injunction is good for 10 days, after which there is an evidentiary hearing to determine whether the injunction should be permanent. If the injunction is converted to a permanent injunction as the result of the hearing, you will be prohibited from owning a firearm. You may be unable to see your children, get into your house, or approach the alleged victim.
